Terms of Service

By accessing or using OpenFunds.app ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform. These Terms apply to all users of the Platform, including donors, fundraisers, and visitors. OpenFunds reserves the right to update these Terms at any time. Continued use of the Platform after changes constitutes your acceptance of the revised Terms.

You must be at least 18 years of age to use the Platform. By creating an account or making a donation, you represent that you are at least 18 years old and have the legal authority to enter into these Terms. If you are accessing the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

You agree to use the Platform only for lawful purposes. You may not: • Create false or misleading campaign information • Use the Platform for fraudulent purposes • Impersonate any person or entity • Violate any applicable laws or regulations • Attempt to gain unauthorized access to any portion of the Platform • Interfere with the proper functioning of the Platform • Collect personal data about users without consent • Use automated tools to access the Platform without permission OpenFunds reserves the right to remove any campaign that violates these Terms and to suspend or terminate accounts of users who engage in prohibited activities.

Campaign organizers are responsible for the accuracy and completeness of their campaign information. OpenFunds does not guarantee that donations will be used as described by campaign organizers. OpenFunds verifies enrollment status and mission commitments where possible, but cannot guarantee the fulfillment of donor benefits promised by campaign organizers or companies. All campaign content must comply with our Community Guidelines. OpenFunds charges a platform fee of 5% on all funds raised. Payment processing fees are separate and vary by payment method.

All donations made through the Platform are voluntary. OpenFunds facilitates the transfer of funds from donors to campaign organizers but is not responsible for how those funds are used. Refunds may be issued at OpenFunds' discretion in cases of verified fraud or platform error. Donors who choose to donate anonymously agree that their identity will not be shared with campaign organizers or displayed publicly. Donations are generally non-refundable unless the campaign is found to be fraudulent or in violation of these Terms.

OpenFunds is committed to protecting your privacy. When you choose the anonymous donation option, your name, email address, and any other identifying information will not be shared with the campaign organizer or displayed publicly on the Platform. Anonymous donors may still receive a payment receipt from the payment processor for tax purposes, but their identity will not be disclosed to the fundraiser. Payments on the Platform are processed by third-party payment providers, including Stripe and PayPal. By making a payment, you agree to the terms and privacy policies of the applicable payment processor. OpenFunds does not store your credit card or bank account information. All payment data is handled by our certified payment partners in accordance with PCI-DSS standards.

All content on the Platform, including text, graphics, logos, and software, is the property of OpenFunds.app or its content providers and is protected by applicable intellectual property laws. Campaign organizers retain ownership of the content they submit. By submitting content, you grant OpenFunds a non-exclusive, worldwide license to use, display, and distribute that content in connection with the Platform.

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. OPENFUNDS DOES NOT GUARANTEE THAT ANY CAMPAIGN WILL REACH ITS FUNDING GOAL OR THAT DONOR BENEFITS WILL BE FULFILLED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPENFUNDS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved through binding arbitration in Dallas County, Texas, except where prohibited by law.
